PRIVATE SPRACHSCHULE FREISING
General Terms and Conditions and Privacy Policy:
1. General Provisions
1.1. The following General Terms and Conditions (GTC) apply
to all contracts between the Private Sprachschule Freising
(hereinafter referred to as “School”) and its customers
(consumers or businesses), hereinafter referred to as
“Customers,” regarding participation in language courses and
other services offered.
1.2. Deviations from these terms require the written consent of
the School.
2. Course Offerings and Registration
2.1. The School offers language courses in various languages.
2.2. Registration for a course is completed by filling out the
registration form. By registering, the participant accepts these
GTC.
2.3. The contract is concluded upon confirmation of the
registration by the School.
2.4. Registrations, changes, and cancellations must be in
writing and addressed exclusively to the School’s management.
3. Participation Fees and Payment Terms
3.1. Participation fees are specified in the course registration
and must be paid in full before the course begins unless
otherwise agreed in writing. In the case of an installment
payment agreement, the first installment is due at this time.
Further installment payments will follow according to the
contractually agreed due dates. The contract concluded

between the customer and Private Sprachschule Freising also
serves as an (ongoing) invoice.
3.2. Payments must be made via bank transfer or other
payment methods offered by the School.
3.3. In the event of payment default, the School may suspend
all ongoing services or exclude the participant from the course,
irrespective of exercising other rights.
3.4. Incoming payments will always be applied to the oldest
debt unless otherwise specified during payment. Unused but
already paid lessons expire three years after the end of the year
in which the claim for conducting the lessons arose unless
otherwise specified in the contract or program duration.
3.5. Special Notice on Termination
For courses already commenced in face-to-face or online group
settings: If the customer is unable to attend lessons (e.g., due to
illness, vacation, or professional commitments), the course fees
remain payable. Termination by either party without notice is
only permissible for a valid reason. If the customer fails to fulfill
their payment obligations and defaults, the Private
Sprachschule Freising is entitled to terminate the contract
without notice.
Separate or differing agreements between the customer and
the School are possible in writing. Refunds of unused but
already paid lessons after the statutory limitation period are
excluded. Customers may provide evidence to the School that
their termination resulted in significantly lower or no cancellation
fees.
The right of both the School and the participant to terminate the
contract for a valid reason remains unaffected. All terminations
must be in text form to be effective.

4. Cancellation, Withdrawal Right for Online
Courses, and Refund Policy
4.1. Customers may cancel free of charge up to 14 days before
the course starts. After this period, the following fees apply:
Up to 1 week before the course starts: 30% of the course fee
Up to 1 day before the course starts: 100% of the course fee
The receipt of the cancellation notice by Private Sprachschule
Freising is decisive for meeting the deadline. Cancellation must
be submitted in writing and addressed to the School.
Withdrawal/cancellation after the course has begun is not
possible, and the full course price is due.
4.2. Withdrawal Right
This withdrawal right does not apply for “in-person courses”
For online language courses, you have the right to withdraw
from this contract within fourteen days without providing a
reason. The withdrawal period is fourteen days from the day the
contract is concluded.
The withdrawal right applies, according to Section 312g(1)
BGB, only to consumers and not to businesses. Additionally,
the withdrawal right for consumers applies only to contracts
concluded outside business premises and for distance contracts
(Section 312c(1) BGB).
The withdrawal must be submitted in text form to Private
Sprachschule Freising by surface mail or e-mail. The withdrawal
form template may be used but is not mandatory. If you use this
option, we will immediately (e.g., via email) confirm receipt of
the withdrawal. It is sufficient to send the notice before the
withdrawal period expires.

4.3. Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments
received from you, including delivery costs (except for additional
costs incurred by choosing a delivery method other than the
most economical standard delivery offered by us). Refunds will
be made promptly and no later than fourteen days from the date
we receive notice of your withdrawal. Refunds will be made
using the same payment method you used for the original
transaction unless otherwise agreed; no fees will be charged for
the refund.

4.5. Special Provisions
The school reserves the right to cancel or reschedule courses
due to insufficient enrollment. In case of cancellation,
participants will receive a full refund or may be rebooked to
another course.
No refund will be issued for missed classes, regardless of the
reason (e.g., illness, vacation).

The school reserves the right to change instructors in
exceptional cases. This does not entitle participants to cancel
the course.
Absence does not constitute withdrawal, and course fees
remain payable.
Individual or small-group lessons must be completed within one
year. After this period, unused lessons expire. Refunds for
unused lessons are not provided.
Rescheduling is permitted but requires the school’s written
approval. Requests for rescheduling must be submitted in
writing at least seven business days before the course begins.
Late or absent requests may be rejected.
5. Special Provisions for Online Programs
5.1. Technical Requirements and Responsibilities
Customers are responsible for ensuring the necessary technical
requirements for accessing and using the booked services,
including hardware, operating system software, internet
connection, firewall settings, and current browser software.
The school does not guarantee compatibility with customers’
devices.
5.2. Access Credentials
Customers must provide participant names when booking and
ensure these participants are aware of and comply with the
GTC. Access credentials (username and password) are for
personal use only and must not be shared.
5.3. Recording of Online Lessons
Customers agree that some online sessions may be recorded
and made available to participants afterward.

6. Liability
6.1. The School is only liable for damages caused intentionally
or through gross negligence. For slight negligence, the School
and its agents are liable only for breaches of essential
contractual obligations and limited to foreseeable and typical
damages.
6.2. The School is not liable for damage to or loss of personal
property.
7. Amendments to the GTC

7.1. The School reserves the right to amend these GTC at any
time. Changes will be communicated in writing or by email.
7.2. Changes are deemed accepted if the participant does not
object in writing within [e.g., 14 days].
8. Final Provisions

8.1. German law applies.
8.2. The place of jurisdiction for all disputes is the School’s
registered office.

4. Legal Basis for Data Processing

fulfillment of the contract in accordance with Article 6(1)(b)
GDPR.
4.2. If you voluntarily provide additional information (e.g., when
subscribing to a newsletter), processing is based on your
consent in accordance with Article 6(1)(a) GDPR.
5. Disclosure of Personal Data

5.1. Your personal data will only be disclosed to third parties if
necessary for contract fulfillment (e.g., to payment service
providers) or if we are legally obligated to do so.
5.2. Your data will not be transferred to a third country.
6. Data Retention

6.1. Your personal data will be stored for as long as necessary
to fulfill the contract or comply with legal retention periods.
7. Your Rights
7.1. You have the right to request information about the
personal data we store about you at any time.

7.2. You have the right to request the correction, deletion, or
restriction of processing of your data.
7.3. You have the right to withdraw your consent at any time.
7.4. You have the right to lodge a complaint with a supervisory
authority if you believe that the processing of your personal
data violates the GDPR.
8. Security Measures
8.1. We implement technical and organizational measures to
protect your data from loss, misuse, and unauthorized access.
9. Changes to the Privacy Policy
9.1. We reserve the right to adapt this privacy policy if
